Use of the website to order products and rent the stuffing machine indicates you will operate the equipment safely and not damage or alter the use of the machine.  Additional damage information will be included in the rental agreement that will be sent through email via DocuSign.  Products cannot be reused, therefore all sales are final and no returns are accepted.  Rarely a plush animal has a defect in the manufacturing process.  If this happens to you, please contact us, so we can assist in fixing the issue.  Must be 18 years or age to order from this site.  Additional Terms include:

Welcome to PlushParty.biz (the “Website”), operated by Cuddles.biz LLC, a company registered in the state of Arizona, USA, with registration number 2944707 (“we,” “us,” “our,” or the “Company”).By accessing or using the Website, placing an order, or creating an account, you agree to be legally bound by these Terms of Use and all terms incorporated by reference. If you do not agree with any part of these Terms, you must not use the Website.

1. EligibilityYou must be at least 18 years old (or the age of majority in your jurisdiction) to use this Website and place orders. By using the Website, you represent that you meet this requirement.

2. Account Registration

• You may be required to create an account to make purchases.
• You are responsible for maintaining the confidentiality of your account login details and for all activities that occur under your account.
• You agree to notify us immediately of any unauthorized use.
• We reserve the right to suspend or terminate accounts at our sole discretion.

3. Products and Orders

• All product descriptions, images, prices, and availability are subject to change without notice.
• We make every effort to display products accurately, but we do not warrant that product descriptions or images are error-free.
• Placing an order constitutes an offer to purchase. We may accept or reject any order at our discretion. Acceptance occurs only when we send an order confirmation email and the item ships.
• Prices are shown in U.S. dollars and include/exclude applicable taxes as indicated at checkout.

4. Pricing and Payment

• We accept debit/credit cards, PayPal, Apple Pay, bank draft and checks (possibly other forms)
• You agree to pay all charges at the prices in effect when you place your order, including shipping and taxes.
• We reserve the right to correct any pricing errors even after an order is placed.

5. Shipping and Delivery

• Shipping times are estimates only; we are not liable for delays caused by carriers or unforeseen events.
• Risk of loss and title for items pass to you upon delivery to the shipping carrier.
• International orders (when accepted) may be subject to customs duties and import taxes, which are your responsibility.

6. Returns, Refunds, and Exchanges - NO RETURNS accepted, these are for personal enjoyment and cannot be restocked and resold, therefore, NO RETURNS are accepted.  Refunds will only be considered when an order is canceled before it has shipped.  Please allow 6-8 weeks for a check to be issued to the person placing the order.  No exchanges are accepted, this is the same rationale as the returns, which are also NOT ACCEPTED.

7. Intellectual Property

• All content on the Website (text, graphics, logos, images, software, etc.) is owned by us or our licensors and is protected by copyright, trademark, and other laws.
• You may not copy, reproduce, modify, distribute, or create derivative works without our prior written consent.

8. User Content

If you post reviews, photos, or other content on any social media:

• You grant us a worldwide, royalty-free, perpetual license to use, modify, and display that content.
• You represent that your content does not violate any third-party rights or applicable law.

9. Prohibited ConductYou agree not to:

• Use the Website for any unlawful purpose
• Attempt to interfere with the Website’s security or functionality
• Use bots, scrapers, or automated tools to access or collect data
• Impersonate any person or entity

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE WEBSITE OR PRODUCTS PURCHASED.  Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.

You agree to indemnify and hold us harmless from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your use of the Website.

13. Governing Law and Dispute 

ResolutionThese Terms are governed by the laws of Arizona, without regard to conflict of law principles.
Any dispute arising out of these Terms or your use of the Website shall be resolved exclusively in the state or federal courts located in Maricopa County, Phoenix, Arizona, USA. You consent to personal jurisdiction in those courts.

14. Termination

We may terminate or suspend your access to the Website immediately, without prior notice, for any reason, including if you breach these Terms.

15. Changes to TermsWe may modify these Terms at any time. The new Terms will be posted on this page with an updated “Effective Date.” Your continued use after changes constitutes acceptance of the new Terms.

16. Force Majeure

We are not liable for failure to perform due to causes beyond our reasonable control (e.g., natural disasters, war, pandemics, carrier delays, etc.).

17. Miscellaneous

• These Terms constitute the entire agreement between you and us.
• If any provision is found unenforceable, the remaining provisions remain in full effect.
